Commonwealth Bank of Australia CEO apologies for financial planning scandal

Ian Narev, the CEO of the Commonwealth Bank of Australia, this morning “unreservedly” apologised to clients who lost money in a scandal involving the bank’s financial planning services arm.

Last week, a Senate enquiry found financial advisers from the Commonwealth Bank had made high-risk investments of clients’ money without the clients’ permission, resulting in hundreds of millions of dollars lost. The Senate enquiry called for a Royal Commission into the bank, and the Australian Securities and Investments Commission (ASIC).

Mr Narev stated the bank’s performance in providing financial advice was “unacceptable”, and the bank was launching a scheme to compensate clients who lost money due to the planners’ actions.

In a statement Mr Narev said, “Poor advice provided by some of our advisers between 2003 and 2012 caused financial loss and distress and I am truly sorry for that. […] There have been changes in management, structure and culture. We have also invested in new systems, implemented new processes, enhanced adviser supervision and improved training.”

An investigation by Fairfax Media instigated the Senate inquiry into the Commonwealth Bank’s financial planning division and ASIC.

Whistleblower Jeff Morris, who reported the misconduct of the bank to ASIC six years ago, said in an article for The Sydney Morning Herald that neither the bank nor ASIC should be in control of the compensation program.

Guatemala police arrested I.T. professional Jean Ramses Anleu Fernández at his Guatemala City home on Thursday on charges of having incited financial panic via messages posted to the Twitter social networking web site. Known as “Jeanfer” on Twitter, Anleu Fernández’s home was raided and his computer seized after he posted a message (known as a “tweet”) on Tuesday afternoon proposing that people “withdraw cash from Banrural, and break the bank of the corrupt,”

Anleu Fernández’s message was posted with the tag “#escandalogt,” identifying it as part of an ongoing discussion on the scandal that broke on Monday when a video recorded by assassinated Guatemalan attorney Rodrigo Rosenberg was distributed at Rosenberg’s funeral and posted to the Internet. In the video, recorded days before he was shot while riding his bicycle in Guatemala City, Rosenberg accuses President of Guatemala Álvaro Colom of complicity in his death. Rosenberg also accused President Colom of responsibility for the April murder of Rosenberg’s client, Khalil Musa, alleging that Musa was killed because he refused to cooperate in corrupt business deals operating within the structure of Banrural, a partly state-run bank. Musa had been appointed by President Colom to the board of Banrural.

Wikinews held an exclusive interview with American author and filmmaker Peter John Ross. The head of Sonnyboo Productions, an independent film studio based in Columbus, Ohio, he has made numerous short films as well as co-directed a feature, the World War II B-movie Horrors of War.

He has also written a book on filmmaking, Tales from the Front Line of Indie Filmmaking. He says that it “combines helpful articles for beginning filmmakers with narrative tales based on my experiences raising money for features and the crazy personalities that invade the world of microbudget filmmaking.”

When asked why he makes movies, Ross replied, “There is no greater thrill than sitting in a room full of strangers watching the stories unfold with flickering pictures and sound. I live for the moments when I can sit there and watch the movies with people I don’t know and really feel how they react to what I wrote or directed or edited.”

Cleveland, Ohio clinic performs US’s first face transplant

A team of eight transplant surgeons in Cleveland Clinic in Ohio, USA, led by reconstructive surgeon Dr. Maria Siemionow, age 58, have successfully performed the first almost total face transplant in the US, and the fourth globally, on a woman so horribly disfigured due to trauma, that cost her an eye. Two weeks ago Dr. Siemionow, in a 23-hour marathon surgery, replaced 80 percent of her face, by transplanting or grafting bone, nerve, blood vessels, muscles and skin harvested from a female donor’s cadaver.

The Clinic surgeons, in Wednesday’s news conference, described the details of the transplant but upon request, the team did not publish her name, age and cause of injury nor the donor’s identity. The patient’s family desired the reason for her transplant to remain confidential. The Los Angeles Times reported that the patient “had no upper jaw, nose, cheeks or lower eyelids and was unable to eat, talk, smile, smell or breathe on her own.” The clinic’s dermatology and plastic surgery chair, Francis Papay, described the nine hours phase of the procedure: “We transferred the skin, all the facial muscles in the upper face and mid-face, the upper lip, all of the nose, most of the sinuses around the nose, the upper jaw including the teeth, the facial nerve.” Thereafter, another team spent three hours sewing the woman’s blood vessels to that of the donor’s face to restore blood circulation, making the graft a success.

The New York Times reported that “three partial face transplants have been performed since 2005, two in France and one in China, all using facial tissue from a dead donor with permission from their families.” “Only the forehead, upper eyelids, lower lip, lower teeth and jaw are hers, the rest of her face comes from a cadaver; she could not eat on her own or breathe without a hole in her windpipe. About 77 square inches of tissue were transplanted from the donor,” it further described the details of the medical marvel. The patient, however, must take lifetime immunosuppressive drugs, also called antirejection drugs, which do not guarantee success. The transplant team said that in case of failure, it would replace the part with a skin graft taken from her own body.

Dr. Bohdan Pomahac, a Brigham and Women’s Hospital surgeon praised the recent medical development. “There are patients who can benefit tremendously from this. It’s great that it happened,” he said.

Leading bioethicist Arthur Caplan of the University of Pennsylvania withheld judgment on the Cleveland transplant amid grave concerns on the post-operation results. “The biggest ethical problem is dealing with failure — if your face rejects. It would be a living hell. If your face is falling off and you can’t eat and you can’t breathe and you’re suffering in a terrible manner that can’t be reversed, you need to put on the table assistance in dying. There are patients who can benefit tremendously from this. It’s great that it happened,” he said.

Dr Alex Clarke, of the Royal Free Hospital had praised the Clinic for its contribution to medicine. “It is a real step forward for people who have severe disfigurement and this operation has been done by a team who have really prepared and worked towards this for a number of years. These transplants have proven that the technical difficulties can be overcome and psychologically the patients are doing well. They have all have reacted positively and have begun to do things they were not able to before. All the things people thought were barriers to this kind of operations have been overcome,” she said.

The first partial face transplant surgery on a living human was performed on Isabelle Dinoire on November 27 2005, when she was 38, by Professor Bernard Devauchelle, assisted by Professor Jean-Michel Dubernard in Amiens, France. Her Labrador dog mauled her in May 2005. A triangle of face tissue including the nose and mouth was taken from a brain-dead female donor and grafted onto the patient. Scientists elsewhere have performed scalp and ear transplants. However, the claim is the first for a mouth and nose transplant. Experts say the mouth and nose are the most difficult parts of the face to transplant.

In 2004, the same Cleveland Clinic, became the first institution to approve this surgery and test it on cadavers. In October 2006, surgeon Peter Butler at London‘s Royal Free Hospital in the UK was given permission by the NHS ethics board to carry out a full face transplant. His team will select four adult patients (children cannot be selected due to concerns over consent), with operations being carried out at six month intervals. In March 2008, the treatment of 30-year-old neurofibromatosis victim Pascal Coler of France ended after having received what his doctors call the worlds first successful full face transplant.

Ethical concerns, psychological impact, problems relating to immunosuppression and consequences of technical failure have prevented teams from performing face transplant operations in the past, even though it has been technically possible to carry out such procedures for years.

Mr Iain Hutchison, of Barts and the London Hospital, warned of several problems with face transplants, such as blood vessels in the donated tissue clotting and immunosuppressants failing or increasing the patient’s risk of cancer. He also pointed out ethical issues with the fact that the procedure requires a “beating heart donor”. The transplant is carried out while the donor is brain dead, but still alive by use of a ventilator.

According to Stephen Wigmore, chair of British Transplantation Society’s ethics committee, it is unknown to what extent facial expressions will function in the long term. He said that it is not certain whether a patient could be left worse off in the case of a face transplant failing.

Mr Michael Earley, a member of the Royal College of Surgeon‘s facial transplantation working party, commented that if successful, the transplant would be “a major breakthrough in facial reconstruction” and “a major step forward for the facially disfigured.”

In Wednesday’s conference, Siemionow said “we know that there are so many patients there in their homes where they are hiding from society because they are afraid to walk to the grocery stores, they are afraid to go the the street.” “Our patient was called names and was humiliated. We very much hope that for this very special group of patients there is a hope that someday they will be able to go comfortably from their houses and enjoy the things we take for granted,” she added.

In response to the medical breakthrough, a British medical group led by Royal Free Hospital’s lead surgeon Dr Peter Butler, said they will finish the world’s first full face transplant within a year. “We hope to make an announcement about a full-face operation in the next 12 months. This latest operation shows how facial transplantation can help a particular group of the most severely facially injured people. These are people who would otherwise live a terrible twilight life, shut away from public gaze,” he said.

According to psychologists in Leipzig, Germany, apes and some birds are able to plan their actions ahead of time.

Psychologists Nicholas Mulcahy and Josep Call at Max Planck Institute for Evolutionary Anthropology say that apes are able to save tools to use at a later time, that will assist them in retrieving food.

The results of the testing are “groundbreaking” and is “a starting point from which we can begin to reconstruct the evolution of the human mind. Apes and jays can also anticipate future needs by remembering past events, contradicting the notion that such cognitive behavior only emerged in hominids,” said Thomas Suddendorf, a psychologist at the University of Queensland Brisbane, Australia.

One aspect of the study is that “our extraordinary abilities of planning for the future did not evolve entirely de novo. Planning for future needs is not uniquely human,” added Suddendorf.

An experiment was performed using bonobos and orangutans. The psychologists placed the apes alone in a room for five minutes. Each of them had a choice of two tools that would allow them to retrieve food and six that would not. The apes were allowed to look at and observe the tools; however, they were not allowed to handle them.

The apes were then taken to a room next door, allowed to take whatever tools they chose, and left alone in the room for at least one hour, while a researcher removed all other tools from the first room. The apes then returned to the first room (where the food was), but the food was not accessible unless they had the right tool to retrieve it.

After repeating the same test several times with each ape, researchers began to see that most apes would begin to use the right tool for the job. Researchers also received similar results even when the apes were left alone in a room overnight where they would sleep.

To make sure that the apes were not associating the tools with the food, they removed the food from the room, but would still give it to the apes if they used the right tool to retrieve it. After this change, most of them did not bring the proper tools, which researchers say confirm that the retrieval is a way of planning for the job.

In experiments using scrub jays (found mostly in the western United States), at the University of Cambridge in the United Kingdom, psychologists have shown that the birds, who usually hide their food to eat later, will hide it again if an enemy bird saw them do it the first time, unless the bird is dominant. The subordinate jay could however, fight the other for the food.

“These results suggest scrub jays remember who observed them make specific caches,” said Joanna Dally who was involved in the study with the scrub jays.

“Together with recent evidence from scrub jays, our results suggest that future planning is not a uniquely human ability, thus contradicting the notion that it emerged in hominids only with the past 2.5 to 1.6 million years,” said Mulcahy and Call in the study.

A book has been written based around leaked political emails sourcing from leader of the New Zealand National party, Doctor Don Brash. The book has been titled The Hollow Men: A Study in the Politics of Deception and it’s by author, Nicky Hager, an activist for left-wing causes.

The release of the book was supposed to be today, however the release of the book has been prohibited by the High Court because of an injunction, issued last week, banning the publication of the leaked emails. The injunction applies to anyone as the plantiifs are in the names of “Jane Doe and John Doe”.

The topics in the book cover a lot ranging from policies and matters to do with the party. The book also includes Dr Brash’s relationship with the exclusive brethren. The books also shows that people within the party, who had denied links with the exclusive brethern, had in fact had links with them. Those people include Dr Brash, John Key the spokesman for finance and Stephen Joyce the campaign manager. The contents page has been revealed, it showed that the book includes political strategies behind the Orewa speech, the input into Nationals campaign from neo-conservatives in America, industry lobby group influences, doners to National and also the election spending strategy that was thought up by Australian advisers.

He also said it looked at a range of possible breaches of election finance laws and parliamentary spending rules.

Mr Hager confirmed that the book doesn’t just use emails but also interviews with people inside the National Party who are unhappy.

Mr Hager said that the book uses emails from Dr Brash that are non-personal and the book does not include anything about Dr Brash’s private life. He said that well-placed sources from within National had provided him with the emails. Mr Hager said: “[The emails did not come] from hacking into the parliamentary server or gaining access to Don Brash’s computer system or something like that”.

In response to the book National has begun to attack Mr Hager’s credibility. Gerry Brownlee, deputy leader, has labbled Mr Hager as a well known intriguist. “Helen Clark roundly ditched him over his Corngate allegations a few years ago and it would be interesting to know what she would make of his latest claims.”

Dr Brash said that it is not expected that their communications with the public would be made public.

The New Zealand Labour party is claiming that this book will be the “death knell” for National. Michael Cullen, deputy prime minister (PM), said: “The claims about Brash’s and John Key’s dealings with the Exclusive Brethren are very damaging. The trouble for the National Party is the book may knock out both of them in one go and the party will have to look beyond Key as leader.”

Current affairs show which is broadcast on TV3, Campbell Live, has filed legal precedings in the high court to allow the publication of the book. Carol Hirshfeld, producer, said: “[Our] lawyers are arguing the court didn’t take sufficient account of the public interest and that constitutes an unreasonable restriction on freedom of expression. Another key point in the application is that Brash knew for some time that the emails were in the public domain, but delayed acting until now.” On today’s show host of Campbell Live, John Campbell, said that he and some of his bosses had read the book.

The injunction stops the publish and broadcast, which includes the internet, of the emails. It is also prohibited to reveal what the emails contain or giving the emails to another person except the High Court where they are supposed to be given.

Oldbury nuclear power station suffers fire

Oldbury nuclear power station in South Gloucestershire, England caught fire today after overheating. No-one was injured in the blaze which is believed to have been an accident and was extuinguished within minutes by an automatic sprinkler system.

The fire took place on the non-nuclear side of the plant, in an electricity transformer, but prompted shutdown of the reactor for the foreseeable future in “accordance with standard procedure,” said Dan Gould, spokesman for the British Nuclear Group. He also stressed that there was no release of radiation. There were also reports of an explosion in the transformer.

The BBC reported that 12 fire trucks attended the scene of the fire, but ITV stated ten crews were involved and tvnz.co.uk quoted a spokesman for Avon Fire and Rescue as saying that ten trucks were sent.

Thaicom, a Thai satellite company has begun airing Hezbollah network Al-Manar, much to Israel’s discontent. Al-Manar now can be viewed in Asia, Australia, Africa, the Middle East, and most of Europe, a blow to Israel who is trying to fight Hezbollah. Many fear this will increase support and recruiting for Hezbollah, which the United States, Israel and some other countries consider a terrorist organization. Thaicom considers Al-Manar programming as “news and entertainment.”

Al-Manar was designated a ‘terrorist entity’, and banned by the United States in December 2004. It has also been banned by France and Spain, and has run into some service and license problems abroad, making it unavailable in the Netherlands, South America and Canada while it has not officially been banned in any of these regions.

The station was launched by Hezbollah in 1991 with the help of Iranian funds. By 2004, Al Manar was estimated to hold 10-15 million viewers daily worldwide. Critics claim al-Manar’s agenda is influenced by Iran by virtue of the “significant portion” of Hezbollah’s budget shortfall that is covered by Iran, via some of the “US$100 and $200 million a year” Iran provides to Hezbollah itself. Al-Manar officials strongly deny this, saying they are subsidized by the Hezbollah party and donations from other Muslims, not by Iran. Al-Manar calls itself the “Station of the Resistance” (qanat al-muqawama) and is a key player in what Hezbollah calls its “psychological warfare against the Zionist enemy”

“It’s a war. Al-Manar is Hezbollah’s main communication tool, through which it spreads anti-Israeli, anti-Semitic, and anti-American incitement. It spreads Hezbollah and Iranian values of radical Islam,” Dr. Reuven Erlich said. Erlich is the head of the Terrorism Information Center in Herzliya, Israel. He added that the fact that Al-Manar can now be seen in south-east Asia, means that Indonesia and Malaysia, two countries with a large Muslim population, are open to its messages of hatred.

Thaicom said it is considering its response and will only offer a formal reaction over the weekend adding the decision to transmit Al-Manar broadcasts was a “purely business decision, which had nothing to do with politics.”
